Jain appointed receiver for Chori Chori ... negatives

The Maharashtra
Court for Control of Organised Crime Act (MCOCA) has appointed
Santosh Singh Jain as the receiver to release the film Chori
Chori Chupke Chupke. The court was intimated last week that
jailed film financier Bharat Shah and 11 distributors of the
film preferred Mahesh Bhatt as receiver. But the police opposed
the appointment on the grounds that Mahesh Bhatt has business
interests with the jailed film financier. As per the courts
ruling on February 12, the money that accrues from the distributors
of the film will remain in the state treasury till a verdict
is passed on the case against Shah. In all probability, the
film will be released in a months time.
Earlier, Special Public Prosecutor Rohini Salian had reiterated
the states opposition to the release of the film. But
Bhatts name was suggested pursuant to the query of the
court with regard to appointing someone within the film industry
as receiver.
Judge AP Bhangale had said that a written undertaking was
necessary from the appointed receiver to the effect that he
was willing to take charge of the assignment and fulfill his
duties in an impartial manner. The judge said the receiver
would not be allowed to enter into private deals with any
of the parties to the contract. More importantly, he would
also have to refrain from entering into transactions detrimental
to the film and also with other known gangsters or persons
connected with organised crime.
Special Public Prosecutor Rohini Salian, had sought time until
February 12 to seek instructions from the investigating officer
whether the appointment of Bhatt as court receiver would be
acceptable to the police.
The release of the film, Chori Chori Chupke Chupke was stalled
after the arrest of producer Nasim Rizvi in December. Thereafter
Shah was also arrested and booked under Maharashtra Control
of Organised Crime Act (MCOCA) on the charge of developing
links with the underworld for personal gains. Shah had moved
the court urging for a direction to release the seized negatives
of the film lying with Adlabs, the film processing firm.
