Court dismisses divorce plea by Adnan’s wife

A family court on Wednesday dismissed the divorce plea by singer Adnan Sami's wife Sabah Galadari saying their marriage is not valid under the Muslim law.

The court, while dismissing the application, held that Sabah had not complied with the Halala formalities under Muslim law which states that a woman has to be married to another man for at least six months before she remarries her first husband.

"Sabah and Adnan were married in 2001 and divorced in 2004. They remarried on April 5, 2007 but when differences cropped between the two Sabah approached the family court here seeking divorce," Adnan's lawyer Vibhav Krishna said.

Sabah had demanded a compensation of Rs five crores and a refund of Rs 5.3 crores allegedly paid by her to Adnan's family members.

Krishna argued before the court that Adnan's marriage to Sabah is not as per law as she has not complied with the Halala formalities under Muslim law.

"Adnan's marriage was dissolved at the request of and with the consent of Sabah and thus required Halala formalities," Krishna said.

Along with the divorce application, Sabah had also filed a case of domestic violence against the singer and had staked claim on his five flats in suburban Andheri.

"The domestic violence complaint also stands dismissed as it was included in the divorce application," Krishna said.

Sabah had also filed a police complaint against Adnan and his parents alleging mental harassment and they had to secure anticipatory bail to avoid arrest.
