



Additional Sessions judge R U Deshmukh granted Benjamin D'Souza (68) anticipatory bail of Rs 25,000 but only after warning him to improve his conduct.
D'Souza was booked for criminal intimidation and using words or gestures to insult the modesty of a woman after Mali's mother filed a complaint against him with the Mahim police station on June 22.
Mali's mother in her complaint had stated that D'Souza has been harassing her family and other residents of the building. D'Souza used to play loud music since early morning and used to throw his garbage into neighbours' home.
"When Mali's mother complained to D'Souza, he started abusing her and used vulgar language about Mali," advocate Renuka Laxman, appearing for Mali's mother said.
However, D'Souza, a retired engineer who lives with his wife in western suburb of Mahim, claimed in his application that his relationship with Mali and her mother strained after he complained to the municipal corporation about an "illegal" water tank she had constructed in her balcony.
According to D'Souza, the ceiling of his second floor flat started caving in under the weight of the water tank.
